The following policies apply to all bookings and engagements with Raw Media Co. ("Raw Media Co.", "we", "us"). By confirming a booking, the Client agrees to be bound by these terms, together with any Session Contract and Model + Location Release Agreement signed for each specific project. "Client" refers to the individual, business, or entity engaging Raw Media Co. for photographic or media services, including their authorised representatives and agents.

COMMUNICATION

Raw Media Co is a big fan of active, clear, honest, respectful and concise communication, and strive to make things as easy as possible for all of us by working proactively and collaboratively with our Client. We understand sometimes things don’t go the way everyone plans, and that’s okay - at the end of the day, we are all human and just doing our best. We endeavour to provide clear, timely communication in general with a Client, especially around any arising issues that will hinder us being able to complete our work for you efficiently and effectively. We also expect that you will aim to give us the same kind of communication in return.

QUOTES, DEPOSITS AND PAYMENTS

Quotes from Raw Media Co are valid for up to 21 days after the initial quote is issued. If the scope of work is changed by either party, the quote will be updated and re-issued before confirmation of your session. A quote does not reserve or guarantee your session date - your booking is only confirmed once a deposit has been received in accordance with our Studio Policies, or your invoice has been paid in full. Quotes that have lapsed can be renewed on request; pricing and availability at the time of re-issue will apply.

A deposit will usually be requested by Raw Media Co to secure a Client booking in advance. For invoices under $3000, it is expected that the invoice amount be paid in full upon receipt of the invoice. However, a 30% deposit is required to secure a booking for sessions over $3000. Required deposits for services invoiced are non-refundable and must be received no later than 7 days prior to the shoot date, unless otherwise arranged in writing. If a deposit has not been received, Raw Media Co reserves the right to postpone the booking until deposit payment is received.

The final invoice must be paid upon receipt of the invoice and in full, including any outstanding invoices not yet paid, unless a payment plan or alternative terms have been agreed to with Raw Media Co prior to invoicing. Raw Media Co reserves the right to withhold delivery of images until full payment has been received. Accounts outstanding more than 14 days after the invoicing date will incur a $100 late fee, payable immediately alongside the outstanding balance.

CANCELLATIONS, RESCHEDULING & WEATHER

Sessions may be cancelled or rescheduled up to 48 hours prior to the confirmed shoot date without penalty. Cancellation within 48 hours of the shoot date will result in loss of the deposit.

Where a shoot must be postponed due to weather or site conditions after travel to the location has commenced, the Client will be charged 100% of the session fee. Where postponement occurs prior to departure, 50% of the session fee will apply. Raw Media Co. will always aim to give as much notice as possible ahead of any changes, such as weather-related postponement, and will always try to work with the Client to secure the next available date that is convenient to both parties.

CLIENT APPROVAL & ON-SITE REPRESENTATIVE

The Client is responsible for ensuring an authorised representative is present during the shoot to approve direction, styling, and coverage, or discussion regarding creative direction has been given prior to the shoot commencement. If no representative is present, Raw Media Co's interpretation of the brief will be accepted as final, and no request for reshoot or rejection of images will be accepted on this basis alone, unless otherwise agreed in writing prior to the shoot.

OVERTIME

Sessions extending beyond 8 consecutive hours in a single day (for shoots and products that are quoted and charged as a day rate) will incur an overtime rate, charged at Raw Media Co.'s standard hourly rate. Where possible, this will be discussed and agreed with the Client in advance prior to shoot commencement.

DELIVERY OF IMAGES

Final images will be delivered via a secure, password protected online gallery or cloud-based transfer link within 7 business days of the shoot date, unless otherwise agreed. Galleries will usually remain accessible for 14 days from the delivery date, after which images may be archived. Extended access or file re-delivery after this period may incur a nominal retrieval fee at the discretion of Raw Media Co.

REVISIONS & RETOUCHING

Each session includes two rounds of minor retouching per selected image (e.g. colour, exposure, minor distractions). These revisions can be viewed either in person with Raw Media Co or via a secure, password protected online gallery where low-resolution “proofs” will be uploaded and feedback can be given. Requests for additional edits, extensive retouching, or changes beyond the original brief will be quoted separately.

IMAGE USAGE & LICENSING

Unless otherwise agreed in writing, the Client’s session fee covers a Base Usage Licence, granting the Client the right to use delivered images for general real estate marketing (such as realestate.com or listings through a company website), general project promotion specific to the project being undertaken, and organic social media use (such as social posts and blog posts), within Australia, for an unlimited period.

Any usage beyond this scope - including national or international advertising campaigns, commercial usage (such as website marketing campaigns, B2B marketing efforts and paid social media promotion where the focus is directly marketing to others and helps aid in generating revenue for the entity in question), print publications of different formats, competition or design award submissions, or third-party commercial use - requires a separate Licensing Agreement or Usage Agreement with Raw Media Co, subject to an additional fee.

Copyright and all intellectual property in the images remains the property of Raw Media Co at all times, consistent with the Model + Location Release Agreement signed for each project. The Licence granted to the Client cannot be transferred, sold, or sub-licensed to a third party without Raw Media Co.'s prior written consent. The Client must not scan, reproduce, alter, or otherwise use images beyond the agreed Licence without Raw Media Co's written consent.

PORTFOLIO & SELF-PROMOTION RIGHTS

Raw Media Co retains the right to use any images captured, at any time, for self-promotion, portfolio display, competition entry, and marketing of its own business - regardless of any usage restrictions granted to the Client - unless a confidentiality and/or embargo period has been agreed in writing (see below).

RESHOOTS

Where a reshoot is requested due to a change of mind, styling changes, or reasons outside Raw Media Co.'s control, the Client will be charged a reshoot fee at the full session rate. Reshoots required due to an error on the part of Raw Media Co. will be provided at no additional cost.

CONFIDENTIALITY & EMBARGO

Where a project is not yet publicly announced or listed (e.g. an unreleased development or pre-launch listing), Raw Media Co will not publish, promote, or share any images of the project - including on social media or in its portfolio - until the Client confirms the project has gone public, or an agreed embargo date has passed.

FILE RETENTION

We strive to retain all copies of all raw/edited/developed files from all our shoots and projects indefinitely - however Raw Media Co will retain raw shoot files for a minimum of 3 months following delivery, and final edited files for a minimum of 12 months. Clients wishing to retain files beyond this period should ensure they have downloaded and securely stored their own copies upon delivery of product.

PAYMENT OPTIONS

Payment is accepted via direct bank transfer (EFT), with account details provided on each invoice. Cash and cheque are also accepted.

PRIVACY

Personal information collected via booking forms, enquiries, or release agreements (including name, contact details, and address) is used solely to manage the Client relationship and deliver services, and will not be shared with third parties except where required to deliver the engaged services.

ENTIRE AGREEMENT

These Studio Policies, together with any Session Contract and Model + Location Release Agreement and other documentation that is signed by the Client for their project/s, form the entire agreement between Raw Media Co and the Client. No alteration, modification, or interpretation of these terms is binding unless made in writing and agreed by both parties.
