INFORMATION ABOUT PHOTOGRAPHIC COPYRIGHT

The Copyright Act 1968 states that the photographer will always own the copyright to an image (unless otherwise agreed to in writing) from the moment said photo is taken.

When engaging our services for photography or videography, you are purchasing a license for specific use of those images, rather than ownership of the images. We retain ownership and copyright of these images, including unlimited rights to use and sell them.

The cost of images is determined by their intended usage. If the usage changes from the original agreement, a new licensing agreement and additional fees will be required. This licensing model helps to keep architectural photography affordable compared to other types of photography services.

Licensing conditions dictate:

  • The images can only be used for the duration of the listing/advertising to sell or rent your property.

  • Once the property has sold, the licence usage also expires.

  • Images licensed for the purpose of advertising a property for rent can be used multiple times for new tenancies so long as it is the purchaser of the image licence who is re-using them (for example, the same property owner or the same agent who purchased the image licence).

  • If the owner of the property paid for the drone, photography and floor plan services but changes agents during the selling process, they can continue to use the images until the property sells.

  • The images are not to be used to advertise or promote the products or services of any third party, such as builders, architects, designers, publications and the like. The third party must contact us for a licence in order to use the images separately to the intended original license.

  • Images licensed for the purpose of listing a property for sale are not to be used to promote the property for holiday let, to re-sell in future or to rent. If the property is to be advertised or promoted for these purposes, a separate licence must be purchased directly from me in order to use them.

  • Images that may be used outside of these purposes, such as for commercial and advertising use seperate to the original intended listing, publications, other websites, property developers, architects, designers and the like, will need their own license negotiated prior to any use.

Intellectual property is a crucial asset for photography businesses. Using a photographer's images without consent or outside the agreed licensing terms is illegal.
